1. What is Mindsets to Thrive and who is it for?

1.1 Mindsets to Thrive is an educational service aimed at supporting mums to improve their body image, develop a sustainable relationship with food and become positive role models for their kids (“the service”).
1.2 The service is delivered via an online coaching program (“the program”) and private coaching sessions (“private sessions”).
1.3 The service is not a psychology service and Mindsets to Thrive does not advise on, assess, diagnose or treat any mental health conditions. The service is not suitable for individuals with mental health issues including (but not limited to) active psychosis, severe depression or active eating disorders. Individuals who are unsure whether the service is suitable should consult their healthcare professional before using the service.

2. What is the structure of the program?

2.1 The program runs over a term of six (6) to eight (8) weeks (“program term”) and consists of two main components: the online modules and live workshops.
2.2 The online modules will focus on a particular topic each week during the program term. The online modules will include videos and other content which will be accessible from
www.mindsetstothrive.com and should take no more than one hour per week to complete.
2.3 The live workshops will be facilitated by Mindsets to Thrive and will take place via online video conferencing. A schedule for the live workshops will be provided at the beginning of the program term. The live workshops are an opportunity for participants to discuss the topic of the week and ask questions. To get the most out of the program, participants are encouraged to review the online modules set for each week before the live workshops. Although the workshops will take place via videoconferencing, Mindsets to Thrive respects participants’ privacy and participants do not need to have their cameras switched on during the live workshop. The live workshops will be recorded and a copy of the recording will be available following the end of the live workshop.

3. Enrolling for the program

3.1 To enrol in the program, individuals must complete an application form available at
www.mindsetstothrive.com and pay the program fee. Following completion of the application form, Mindsets to Thrive will contact applicants to confirm their enrolment into the program. Individuals who are or were clients of Amanda Kenyon within the last two years are not eligible to enrol in the program.

3.2 Completion of an application form and payment of the program fee does not guarantee enrolment into the program. Mindsets to Thrive may, in its absolute discretion, reject an application for any reason. If Mindsets to Thrive rejects an application, a refund of the program fee will be issued subject to these terms and conditions.
3.3 Access to the online modules and the weekly live workshops will be made available after enrolment into the program is confirmed.

3.4 By completing the application form, the applicant agrees to:
(a) review the online modules set for each week during the program term;
(b) complete any exercises set in the online modules;
(c) use their best endeavours to participate in the live workshops from a private and/or quiet location;
(d) interact with Mindsets to Thrive and other participants respectfully at all times; and
(e) keep confidential all matters discussed with other participants.


4. Private sessions

4.1 After completing the program, participants may be invited to participate in private sessions with Mindsets to Thrive. Private sessions will be subject to additional fees.

Where a private session is offered, participants must book the private session on the Mindsets to Thrive website.


5. Payments, refunds and cancellations

5.1 The program fee is payable at the time that an application to enrol in the program is made and, subject to these terms, is not refundable.
5.2 Mindsets to Thrive may use third-party services to process payment of the program fee. By making payment using these third-party services, applicants may be responsible for additional fees charged by these third-party services which are not refundable.
5.3 If a participant is unable to attend a live workshop, a recording of the session will be made available. No refunds will be given if a participant is unable to attend a live workshop.

5.4 Private sessions must be paid for in full at the time of booking. Any fees paid for a private session that is not attended by the participant will be forfeited.

5.5 Subject to clause
5.6, a participant may cancel a private session and receive a refund provided that the private session is cancelled with no less than 24 hours written notice to Mindsets to Thrive.
5.6 Private sessions that are booked as part of a bundle are not refundable. A participant may reschedule a private session booked as part of a bundle provided that a written request to reschedule is provided to Mindsets to Thrive no less than 48 hours prior to the private session to be rescheduled.

6. Termination

6.1 Mindsets to Thrive may, in its absolute discretion, suspend or terminate the service at any time if:
(a) Mindsets to Thrive forms the opinion that a participant is not suited to the service;
(b) Mindsets to Thrive forms the opinion that a conflict of interest may exist between it and a participant; or
(c) a participant is in breach of these terms and conditions.

6.2 If a participant’s enrolment is terminated pursuant to 6.1(a) or 6.1(b), Mindsets to Thrive may issue a partial or full refund of the program fee subject to these terms and conditions.

6.3 If a participant is unable to complete the program during the program term, Mindsets to Thrive may, in its absolute discretion, allow the participant to re-enrol in the program at a later date at no additional cost.

7. Confidentiality, privacy and consent

7.1 Participants must at all times keep confidential any information disclosed in any form by other participants during the program.
7.2 Although Mindsets to Thrive will use reasonable endeavours to maintain the confidentiality of information disclosed by participants during live workshops, Mindsets to Thrive cannot guarantee that information disclosed to other participants during the live workshops will be confidential and Mindsets to Thrive will not be liable to any person for any loss, damage or expense suffered or incurred arising from such disclosure.
7.3 Mindsets to Thrive will collect and record personal information subject to its privacy policy which can be viewed at
www.mindsetstothrive.com/privacy. By applying to enrol in the program, participants accept the terms of Mindsets to Thrive privacy policy.7.4
By participating in the live workshops, participants acknowledge and agree that:
(a) the live workshops, including any video, audio or other information transmitted by the participant during the live workshops, will be recorded by Mindsets to Thrive;
(b) the recordings will be accessible by Mindsets to Thrive and other participants in the program who are unable to join the live workshop or wish to review the recording;
(c) Mindsets to Thrive may retain the recordings and use them to improve the services it provides; and
(d) they have consented to the recording, retention, and use of their contributions in the live workshops, including their likeness, voice, and any personal information they choose to share during the session.

8. Intellectual property

8.1 Thecontent provided by Mindsets to Thrive, including the content on the Mindsets to Thrive website, online modules, recordings of the live workshops, text, logos, artwork, graphics, audio, video clips and any other digital downloads (“the content”) are, unless otherwise specified, the intellectual property of Mindsets to Thrive and are protected by applicable copyright, trademark, and other intellectual property laws.

8.2 Participants are granted a limited, non-exclusive, non-transferable licence to access the content for personal, non-commercial use only.
8.3 Any other use, including the reproduction, modification, distribution, transmission, republication, display, or performance of the content without the prior written permission of Mindsets to Thrive is strictly prohibited.

9. Technology requirements

9.1 The program will be delivered online on the Mindsets to Thrive website and Zoom videoconferencing software. Participants are responsible for ensuring that they have the appropriate technology to access and participate in the program. This includes having access to a computer, tablet, or smartphone with a functioning microphone, audio output device (such as speakers or a headphones) and reliable internet access.
9.2 Participants must ensure that their devices can access the Mindsets to Thrive website and run the software and applications required to access the online modules and participating in the live workshops. Mindsets to Thrive is not responsible for any technical issues or limitations that may prevent participants from fully engaging in the program.


10. Governing law

These terms and conditions are governed by the laws of New South Wales. Mindsets to Thrive and the participant irrevocably submit to the laws and courts of New South Wales.

11. Acknowledgement by participant

I confirm that I have read and understood the information in this document, and acknowledge that:· Mindsets to Thrive is not a psychology service and does not advise on, assess, diagnose or treat any mental health conditions;· I have consulted my healthcare professional if I have any mental health issues or concerns about my suitability in the program or private session; and· I have not been a client of Amanda Kenyon within the last two (2) years and will be precluded from accessing psychological services provided by Amanda Kenyon for a minimum period of six (6) months after receiving services from Mindsets to Thrive.
